MCA debt in Nevada
According to the SBA Office of Advocacy, Nevada is home to about 353,600 small businesses employing roughly 45% of its workforce. Most of those jobs are in restaurants and hospitality, construction and health care, and owners in those sectors are frequent targets of MCA offers.
Nevada MCA law: what actually protects you
Cost disclosure rules
Nevada has not enacted a commercial financing or MCA disclosure law, so funders don't have to show you a standardized total cost or APR before you sign.
Confession-of-judgment rules
Nevada allows confessions of judgment, but the defendant must sign a sworn written statement for a specified sum stating the facts showing it is justly due (NRS 17.090 to 17.110).
Usury and rate caps
Nevada generally lets parties agree to any interest rate, so recharacterizing an MCA as a loan gives little usury leverage under Nevada law.
What this means for Nevada owners
Because Nevada still allows confessions of judgment, a funder may be able to get a judgment quickly if you signed one. Find out before you miss a payment, not after. On the rate side, Nevada law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.
