MCA debt in Oregon
With about 417,700 small businesses employing around 53% of the workforce (SBA 2025 profile), Oregon has a large base of owners using short-term financing. Restaurants, health care and construction lead small-business employment.
Oregon MCA law: what actually protects you
Disclosure requirements
Oregon is not among the states that require standardized MCA cost disclosures. That makes an independent review of each offer more important.
Judgment by confession
If your MCA includes confession-of-judgment language, have an Oregon attorney review it; Oregon's procedures don't fit the pre-signed clauses MCA funders use.
Is an MCA subject to usury limits?
Oregon is notable: loans of $50,000 or less, including business loans, are capped at the greater of 12% or five points above the Federal Reserve discount rate, and a violation forfeits all interest (ORS 82.010). If an MCA of $50,000 or less were treated as a loan, that cap could matter.
What this means for Oregon owners
Oregon's rules on confessions of judgment in business contracts aren't as clear-cut as in some states, so treat any confession clause as live until an attorney tells you otherwise. On the rate side, Oregon is one of the few states where usury law could still matter if an MCA is recharacterized as a loan, so the effective annual rate on each of your advances is worth calculating.
