MCA Debt Help · Utah

MCA debt help for Utah business owners.

Utah requires merchant cash advance providers and brokers to register and to disclose costs on deals up to $1 million, one of the highest thresholds in the country. Utah law also lets parties agree to almost any rate. We help Utah owners understand what that means for advances they already have, on a flat fee.

MCA debt in Utah

Utah has about 372,000 small businesses employing roughly 690,000 people, according to the SBA Office of Advocacy's 2025 profile. Construction leads small-business employment, followed by restaurants, health care and retail, and fast growth along the Wasatch Front has pushed many contractors toward quick financing.

Utah MCA law: what actually protects you

Commercial Financing Registration and Disclosure Act (Utah Code Title 7, Ch. 27)

For transactions closed on or after January 1, 2023, providers of MCAs, business loans and other commercial financing up to $1 million must give cost disclosures before closing, and providers and brokers must register with the Utah Department of Financial Institutions. Since a 2024 amendment, registration runs through the national licensing system (NMLS) and is renewed each year. Banks, real-estate-secured deals and providers doing five or fewer deals a year are exempt.

Confessions of judgment

Utah allows judgment by confession without a lawsuit, in the manner set by law (Utah Code § 78B-5-205). If your MCA contains a confession, take it seriously and have it reviewed.

Usury

Utah lets parties agree to any interest rate in a contract (Utah Code § 15-1-1), so arguing that an MCA is a usurious loan does little under Utah law. The arguments that matter more are whether the funder honored the reconciliation clause, whether it was registered and gave the required disclosure, and what the contract's New York choice-of-law clause allows.

How we help Utah owners

We are a flat-fee, independent MCA debt advisory firm based at 30 Montgomery Street in Jersey City, New Jersey, working with business owners nationwide by phone and video. We don't lend, we don't broker, and we don't take a percentage of any settlement, so our only job is to show you which path actually fits your numbers. A typical engagement starts with a free 30-minute review of your MCA contracts, your bank statements and any offers you've received, followed by a written plan comparing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.

Commercial financing of $1 million or less closed on or after January 1, 2023, including MCAs, business loans and open-end credit, unless an exemption applies.
