MCA debt in Arizona
Arizona has about 707,000 small businesses employing roughly 1.2 million people, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants, construction and professional services lead, and summer slowdowns in tourism-dependent businesses make fixed daily debits hard to carry.
Arizona MCA law: what actually protects you
Pre-signed confessions of judgment don't work
Under A.R.S. § 44-143, a judgment by confession can't be entered unless the power to confess was signed and acknowledged after the debt became due. That effectively blocks confessions signed at closing, which is how MCA contracts use them.
No disclosure law
Arizona has not enacted a commercial financing disclosure law, so funders don't have to show you a standardized cost or APR.
Usury
Arizona lets parties agree in writing to any interest rate (A.R.S. § 44-1201), so recharacterizing an MCA as a loan gives little usury leverage under Arizona law. Your stronger tools are usually the reconciliation clause and a careful review of what each funder has collected.
If you're behind on an MCA in Arizona
- Don't sign a new confession of judgment as part of a "workout" without legal advice. One signed after default may be enforceable.
- Request reconciliation during seasonal slowdowns. See our reconciliation clause guide.
- Calculate the true cost. See our factor rate to APR guide.
- Contractors: see our construction page.
How we help Arizona owners
We are a flat-fee, independent MCA debt advisory firm based at 30 Montgomery Street in Jersey City, New Jersey, working with business owners nationwide by phone and video. We don't lend, we don't broker, and we don't take a percentage of any settlement, so our only job is to show you which path actually fits your numbers. A typical engagement starts with a free 30-minute review of your MCA contracts, your bank statements and any offers you've received, followed by a written plan comparing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.

We work with owners throughout Arizona, including Phoenix, Tucson, Mesa, Scottsdale, Chandler, Glendale and Flagstaff.
