MCA debt in Washington
Small businesses carry the Washington economy: roughly 695,700 of them employ about 49% of the state's workers, per the SBA's 2025 state profile. The biggest small-business employers are in health care, restaurants and construction, where card-split and daily-ACH advances are widespread.
Washington MCA law: what actually protects you
Do funders have to disclose the cost?
Washington is not among the states that require standardized MCA cost disclosures. That makes an independent review of each offer more important.
Can a funder get a judgment without a lawsuit?
Washington allows confessions of judgment based on a written, signed, sworn statement of a specified sum and the facts behind the debt (RCW 4.60.060).
Interest-rate limits
Washington caps interest at the greater of 12% or four points above the T-bill rate, but corporations, LLCs, partnerships and people borrowing for business purposes can't raise usury (RCW 19.52.080), so usury rarely helps a Washington business.
What this means for Washington owners
Because Washington still allows confessions of judgment, a funder may be able to get a judgment quickly if you signed one. Find out before you miss a payment, not after. On the rate side, Washington law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.
