MCA debt in Alaska
Small businesses carry the Alaska economy: roughly 77,800 of them employ about 54% of the state's workers, per the SBA's 2025 state profile. The biggest small-business employers are in health care, restaurants and retail, where card-split and daily-ACH advances are widespread.
Alaska MCA law: what actually protects you
Do funders have to disclose the cost?
There is no Alaska law requiring MCA providers to disclose an APR or total cost of financing. You'll need to work out the real cost yourself, or with an advisor.
Can a funder get a judgment without a lawsuit?
Alaska allows a confession of judgment only with formalities: a written confession signed by the defendant, written assent by the creditor, and an acknowledgment before an officer or an appearance in court (Alaska Civil Rule 57(b)).
Interest-rate limits
Alaska caps interest at the greater of 10% or five points over the Federal Reserve rate, but loans over $25,000 are exempt (AS 45.45.010). Many MCAs exceed that amount.
What this means for Alaska owners
Alaska puts procedural hurdles in front of confessions of judgment, so a clause buried in your MCA isn't a shortcut to a judgment the way it can be elsewhere. On the rate side, Alaska law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.
