MCA debt in Illinois
Illinois has about 1.4 million small businesses employing roughly 2.4 million people, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants, manufacturing and professional services lead, and Chicago's restaurant and trucking sectors are among the heaviest MCA users in the Midwest.
Illinois MCA law: what actually protects you
Disclosure bills are pending, not law
Illinois has not enacted a commercial financing disclosure law. An earlier bill died in January 2025, and 2025 bills (SB 260, HB 3477 and HB 2595) that would require registration and disclosures had stalled as of October 2026. Until something passes, funders don't have to show you a standardized cost or APR.
Confessions of judgment
Illinois allows confessions of judgment on business contracts under 735 ILCS 5/2-1301(c), but only in the county where the document was signed, where a defendant lives, or where the defendant has property. A judgment entered in any other county is invalid. Confessions are void in consumer transactions.
Usury
Illinois allows any rate on loans to corporations and on business loans (815 ILCS 205/4), so even if an MCA were treated as a loan, Illinois usury law would rarely help. The New York law most MCA contracts choose is a separate question.
If you're behind on an MCA in Illinois
- Calculate the true cost yourself. See our factor rate to APR guide.
- Check where any confession of judgment was filed. The wrong county makes it invalid.
- Trucking and restaurant owners: see factoring and MCAs in trucking and split-funding MCAs.
- Request reconciliation when revenue drops. See the reconciliation clause guide.
How we help Illinois owners
We are a flat-fee, independent MCA debt advisory firm based at 30 Montgomery Street in Jersey City, New Jersey, working with business owners nationwide by phone and video. We don't lend, we don't broker, and we don't take a percentage of any settlement, so our only job is to show you which path actually fits your numbers. A typical engagement starts with a free 30-minute review of your MCA contracts, your bank statements and any offers you've received, followed by a written plan comparing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.
