MCA debt in Alabama
Alabama has about 465,600 small businesses, which account for roughly 46% of the state's employment, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants and retail employ the most people, and those are sectors where daily or weekly MCA debits are common.
Alabama MCA law: what actually protects you
Disclosure
Alabama has not enacted a commercial financing or MCA disclosure law, so funders don't have to show you a standardized total cost or APR before you sign.
Confessions of judgment
Alabama voids agreements made before a lawsuit to confess judgment, and also voids agreements to be sued in another venue (Ala. Code § 8-9-11). A pre-signed confession in an MCA contract shouldn't be usable in Alabama.
Usury
Alabama caps interest at 8% under a written contract, but loans of $2,000 or more may carry any agreed rate (Ala. Code § 8-8-5), so usury arguments under Alabama law rarely help a business with an MCA.
What this means for Alabama owners
Alabama law works in your favor on confessions of judgment: a pre-signed clause in your MCA shouldn't be enforceable here, so a funder that wants a judgment generally has to sue you and prove its case. On the rate side, Alabama law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.
If you're behind on an MCA in Alabama
- Look for a confession of judgment and an out-of-state venue clause; Alabama voids both when agreed before a lawsuit.
- Medical and dental practices: see our healthcare page on matching payments to reimbursement cycles.
- Restaurants and hospitality: see how split-funding MCAs work and our food service page.
- Calculate the true cost. Our factor rate to APR guide shows how.
- Request reconciliation in writing if revenue has dropped. See the reconciliation clause guide.
How we help Alabama owners
Our role is narrow on purpose: we're independent advisors, paid a flat fee, with no lender partnerships and no cut of any settlement. For Alabama owners that means a free first review of your MCA contracts and cash flow, then a written plan weighing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.

We work with owners throughout Alabama, including Birmingham, Huntsville, Montgomery, Mobile and Tuscaloosa.
