MCA Debt Help · Tennessee

MCA debt help for Tennessee business owners.

Merchant cash advance rules differ by state, and Tennessee has its own on confessions of judgment, interest limits and disclosures. Here's what matters for Tennessee businesses, and how we can help on a flat fee.

MCA debt in Tennessee

With about 741,200 small businesses employing around 42% of the workforce (SBA 2025 profile), Tennessee has a large base of owners using short-term financing. Restaurants, health care and retail lead small-business employment.

Tennessee MCA law: what actually protects you

Disclosure requirements

Tennessee has not enacted a commercial financing or MCA disclosure law, so funders don't have to show you a standardized total cost or APR before you sign.

Judgment by confession

Tennessee voids a power to confess judgment given before a lawsuit is filed (Tenn. Code Ann. § 25-2-101).

Is an MCA subject to usury limits?

Tennessee caps written contract rates at the lesser of prime plus four points or 24%, with no general business exemption (Tenn. Code Ann. §§ 47-14-102, -103). But commercial parties may choose another state's law in writing (§ 47-14-119), which is why most MCAs choose New York.

What this means for Tennessee owners

Tennessee law works in your favor on confessions of judgment: a pre-signed clause in your MCA shouldn't be enforceable here, so a funder that wants a judgment generally has to sue you and prove its case. On the rate side, Tennessee is one of the few states where usury law could still matter if an MCA is recharacterized as a loan, so the effective annual rate on each of your advances is worth calculating.
