MCA debt in Oklahoma
According to the SBA Office of Advocacy, Oklahoma is home to about 395,500 small businesses employing roughly 51% of its workforce. Most of those jobs are in health care, restaurants and retail, and owners in those sectors are frequent targets of MCA offers.
Oklahoma MCA law: what actually protects you
Cost disclosure rules
There is no Oklahoma law requiring MCA providers to disclose an APR or total cost of financing. You'll need to work out the real cost yourself, or with an advisor.
Confession-of-judgment rules
Oklahoma requires the debtor to appear personally in court to confess judgment, with the creditor's assent (12 O.S. § 689), so a confession clause signed at closing doesn't fit Oklahoma procedure.
Usury and rate caps
Oklahoma's interest rules for non-consumer credit are set by its consumer credit code; for MCAs, the New York law in most contracts usually matters more.
What this means for Oklahoma owners
Oklahoma puts procedural hurdles in front of confessions of judgment, so a clause buried in your MCA isn't a shortcut to a judgment the way it can be elsewhere. On the rate side, Oklahoma law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.
