MCA debt: should you call a consultant, a settlement company or a lawyer?

Each one does a different job. Calling the wrong one first can cost you time, fees or a court deadline. Here is how to tell which you need.

The short answer: If you're still paying but the daily debits are hurting, start with a consultant who can show you all your options. If you're ready to negotiate with funders, you need a settlement company. If a funder has sued you, entered a confession of judgment or frozen your bank account, call a lawyer first.

Questions that tell you which you need

  • Has a funder filed a lawsuit or sent a restraining notice to your bank? Call a lawyer. See when you actually need a business debt lawyer.
  • Have you stopped paying or received a default notice? A settlement company or a lawyer, depending on the funder's next step. Here is what happens when you default.
  • Are you current but struggling, or unsure whether settlement, refinancing or a reconciliation fits? A consultant. Compare restructuring and settlement.
  • Are you being offered a new advance to pay off the old ones? Get an independent opinion before you sign. Stacking usually makes the daily debits worse.

Red flags with any of them

  • Guaranteed savings or a promise that lawsuits won't happen.
  • Pressure to stop paying funders before you understand the risks.
  • Fees that aren't written down before you sign. Federal rules limit when debt settlement companies can charge.
  • No clear answer on who actually negotiates or who appears in court.

Frequently asked questions

Can I hire a consultant and a lawyer at the same time?
Yes. Many business owners use a consultant to understand their options and a lawyer for any lawsuit or judgment. The two roles do not overlap when each is clear about what it handles.

Does a debt settlement company protect me from lawsuits?
No. A settlement company negotiates with funders, but it cannot stop a funder from suing. If you are sued, you need an attorney to respond.

Does Renaissance Capital Advisors negotiate with my funders?
No. Rencap is a consulting firm. When your plan needs negotiation or legal work, we refer you to a partner debt settlement firm or our partner law firm.
