MCA debt in Delaware
Delaware has about 111,300 small businesses, which account for roughly 51% of the state's employment, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants and professional services employ the most people, and those are sectors where daily or weekly MCA debits are common.
Delaware MCA law: what actually protects you
Disclosure
There is no Delaware law requiring MCA providers to disclose an APR or total cost of financing. You'll need to work out the real cost yourself, or with an advisor.
Confessions of judgment
Delaware allows confessions of judgment, but with safeguards: the creditor must send notice by certified mail, and if you appear, the court holds a hearing where the creditor must prove you validly waived notice and a hearing (10 Del. C. § 2306 and Superior Court Civil Rule 58.1). Respond to any notice right away.
Usury
Delaware caps interest at the Federal Reserve discount rate plus five points, but loans over $100,000 not secured by your home are uncapped, and corporations and LLCs can't raise a usury defense.
What this means for Delaware owners
Delaware puts procedural hurdles in front of confessions of judgment, so a clause buried in your MCA isn't a shortcut to a judgment the way it can be elsewhere. On the rate side, Delaware law gives business borrowers little usury protection, so your leverage is more likely to come from the reconciliation clause, documentation of your revenue and a clear plan for each funder.

- Don't take a new advance to cover an old one without modeling the combined debit. See how MCA stacking works.
- Calculate the true cost. Our factor rate to APR guide shows how.
How we help Delaware owners
Our role is narrow on purpose: we're independent advisors, paid a flat fee, with no lender partnerships and no cut of any settlement. For Delaware owners that means a free first review of your MCA contracts and cash flow, then a written plan weighing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.

We work with owners throughout Delaware, including Wilmington, Dover, Newark, Middletown and the beach towns of Sussex County.
