MCA debt in Connecticut
Connecticut has about 381,000 small businesses employing roughly 726,000 people, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants, manufacturing and retail lead small-business employment.
Connecticut MCA law: what actually protects you
Disclosure and registration (Conn. Gen. Stat. § 36a-861 et seq.)
Under Public Act 23-201, since July 1, 2024 providers of sales-based financing up to $250,000 must give a cost disclosure, and providers and brokers must register with the Connecticut Department of Banking through NMLS. The Department has penalized at least one out-of-state provider for financing hundreds of Connecticut businesses without registering.
No more account freezes without a hearing
Connecticut law has allowed a creditor in a commercial transaction to obtain a prejudgment remedy, such as freezing a bank account, without a hearing if the contract contained a waiver, and MCA funders used this often. For commercial financing contracts signed on or after July 1, 2024, those waivers are unenforceable (§ 36a-868).
Usury
Connecticut's general usury cap is 12% a year, and its courts look at substance over form. Whether an MCA can be treated as a usurious loan in Connecticut has not been fully litigated, and most MCA contracts choose New York law, which applies its own three-part test.
If you're behind on an MCA in Connecticut
- Check the signing date. If you signed on or after July 1, 2024, a waiver of your right to a hearing before an account freeze is unenforceable.
- Confirm the funder is registered with the Department of Banking.
- Find your disclosure for deals up to $250,000.
- Request reconciliation if revenue has dropped. See our reconciliation clause guide.
How we help Connecticut owners
We are a flat-fee, independent MCA debt advisory firm based at 30 Montgomery Street in Jersey City, New Jersey, working with business owners nationwide by phone and video. We don't lend, we don't broker, and we don't take a percentage of any settlement, so our only job is to show you which path actually fits your numbers. A typical engagement starts with a free 30-minute review of your MCA contracts, your bank statements and any offers you've received, followed by a written plan comparing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.
