MCA debt in Louisiana
Louisiana's roughly 511,000 small businesses employ more than half of the state's private workforce, according to the SBA Office of Advocacy's 2025 profile. Health care, restaurants and hospitality, retail and construction lead, and hurricane disruptions can turn a manageable daily debit into a crisis overnight.
Louisiana MCA law: what actually protects you
Revenue-based financing disclosures (La. R.S. 9:3137.10)
Since August 1, 2025, under Act 198 of 2025, providers of revenue-based financing, where payments rise and fall with sales, must disclose the total funds provided, the amount disbursed, total repayment, total cost, the payment schedule and prepayment terms. There is no dollar cap and no exemption for banks. The law has no registration requirement and no stated penalties.
The "not a loan" declaration
The same law states that revenue-based financing is not a transaction for the use of money and its charges are not interest. Combined with Louisiana's rule letting commercial borrowers agree to any rate (La. R.S. 9:3509), usury is effectively off the table under Louisiana law. That makes the reconciliation clause, which is what makes an MCA "revenue-based" in the first place, your most important tool.
Executory process
Louisiana's version of a confession of judgment is executory process, which lets a creditor seize and sell property without a full lawsuit, but it applies to property covered by a mortgage or privilege in an authentic act. Most MCAs are unsecured, so check whether yours includes any such security.

How we help Louisiana owners
We are a flat-fee, independent MCA debt advisory firm based at 30 Montgomery Street in Jersey City, New Jersey, working with business owners nationwide by phone and video. We don't lend, we don't broker, and we don't take a percentage of any settlement, so our only job is to show you which path actually fits your numbers. A typical engagement starts with a free 30-minute review of your MCA contracts, your bank statements and any offers you've received, followed by a written plan comparing reconciliation, renegotiation, refinancing, settlement through a licensed provider, or attorney review.
